By using FaxDrop, you agree to these terms. Please read them. Key points: you are responsible for what you fax, we are a relay service not a fax sender, and unsolicited commercial faxes are prohibited.
1. Acceptance of Terms
By accessing or using FaxDrop (faxdrop.com), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
2. Description of Service
FaxDrop provides an online fax relay service that transmits documents you provide to fax numbers you specify. FaxDrop acts solely as a relay platform. We transmit documents on your behalf. We do not initiate faxes, select recipients, or determine content.
3. TCPA Compliance: Your Responsibility
The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and related regulations may restrict certain fax transmissions, particularly unsolicited commercial faxes. YOU, as the sender, bear sole responsibility for compliance with the TCPA and all applicable federal, state, and local laws governing fax communications. FaxDrop is a relay infrastructure provider and is not liable for content you choose to transmit or recipients you choose to contact. By using FaxDrop, you represent and warrant that your use complies with all applicable laws.
4. Prohibited Uses
You may not use FaxDrop to: (a) send unsolicited commercial fax advertisements without recipient consent; (b) transmit illegal content including material that infringes intellectual property rights; (c) harass, threaten, or harm any person; (d) circumvent or abuse our freemium limits through automated means; (e) resell or sublicense the service; or (f) violate any applicable law or regulation.
5. Free Tier and Paid Plans
FaxDrop offers 2 free faxes per rolling 30-day period per email address. Additional faxes require a paid plan or pay-per-fax purchase. Paid credits do not expire. Subscription plans renew monthly and may be cancelled at any time. Refunds are issued at our sole discretion for technical failures on our part.
6. Service Availability
FaxDrop is provided on an as-is basis. We do not guarantee delivery of any specific fax transmission. Delivery depends on the recipient fax machine being operational and available. We are not liable for failed transmissions caused by recipient-side equipment, busy lines, or network conditions outside our control.
7. Limitation of Liability
To the maximum extent permitted by law, FaxDrop and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or goodwill, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid to FaxDrop in the 30 days preceding the claim.
8. Termination
We reserve the right to suspend or terminate your access to FaxDrop at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
9. Changes to Terms
We may update these Terms from time to time. Continued use of FaxDrop after changes constitutes acceptance of the new Terms.
